Welcome to Deccan Drip.
This document constitutes an electronic record within the meaning of the Information Technology Act, 2000 and the rules framed thereunder, including the rules requiring publication of terms of use, privacy policy and other policies for access to or use of a digital platform. This electronic record is generated by a computer system and does not require any physical or digital signature.
These Terms & Conditions (“Terms”) govern your access to and use of the Deccan Drip website and all associated digital platforms, including all content, features, tools, products and services made available thereon (collectively, the “Platform”). The Platform is owned and operated by Deccan Drip, based in Hyderabad, Telangana, India (hereinafter referred to as “Deccan Drip”, “we”, “us” or “our”).
For the purposes of these Terms, “you”, “your” or “User” means any natural person or legal entity who accesses, browses, registers on, purchases from, or otherwise uses the Platform in any manner. Where the User is a minor or is otherwise not competent to contract under applicable law, such use shall be deemed to be through a parent or legal guardian competent to contract, who shall be bound by these Terms on behalf of such User.
By accessing, browsing, registering on or using the Platform, you acknowledge that you have read, understood and agreed to be bound by these Terms, together with our Refund & Return Policy, Shipping Policy and Privacy Policy, each of which is incorporated herein by reference. These Terms constitute a legally binding agreement between you and Deccan Drip. If you do not agree with any part of these Terms, you must discontinue use of the Platform.
1. Eligibility
You must be at least eighteen (18) years of age and competent to contract under the Indian Contract Act, 1872 in order to place an order on the Platform. By transacting on the Platform, you represent and warrant that you meet this requirement.
2. Registration and account security
Certain features of the Platform may require registration. You agree to provide accurate, current and complete information during registration and to keep it updated. You are solely responsible for maintaining the confidentiality of your login credentials and for all activity conducted through your account. You must notify us immediately of any unauthorised use of your account.
3. Products, descriptions and colour representation
We endeavour to describe and display our products as accurately as possible. However, colour reproduction depends on your device and display settings, and actual shades may vary marginally from those shown on screen. Garment measurements published on our Size Guide are subject to a manufacturing tolerance of up to 0.5 inch. All products are offered subject to availability, and we reserve the right to limit quantities or decline to supply any product.
4. Pricing, taxes and errors
All prices are quoted in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise. Prices, offers and discounts are subject to change without prior notice. In the event a product is displayed at an incorrect price owing to a typographical, technical or system error, we reserve the right to cancel the affected order and refund the amount paid in full, notwithstanding that an order confirmation has been issued.
5. Orders and formation of contract
Your order constitutes an offer to purchase. Our acknowledgement of receipt of an order does not amount to acceptance. A binding contract is formed only upon dispatch of the goods. We reserve the right to cancel or decline any order, including on grounds of stock unavailability, pricing error, suspected fraudulent activity, incomplete address details or non-serviceable delivery locations.
6. Payment
Payments are processed through Shopify’s PCI-DSS compliant checkout and authorised third-party payment gateways. We neither collect nor store your card or banking credentials. You represent that any payment instrument used by you is lawfully yours or that you are duly authorised to use it.
7. Shipping, returns and refunds
Delivery timelines, shipping charges, returns, exchanges, cancellations and refunds are governed by our Shipping Policy and Refund & Return Policy, which form an integral part of these Terms.
8. Intellectual property
All content on the Platform, including the Deccan Drip name, logo, wordmark, product designs, photographs, text, graphics, layout and source code, is the property of Deccan Drip or its licensors and is protected under applicable intellectual property laws. No part of the Platform may be reproduced, distributed, republished or exploited commercially without our prior written consent.
9. Acceptable use
You agree not to use the Platform for any unlawful purpose; to scrape, crawl, harvest or extract data by automated means; to attempt to gain unauthorised access to the Platform or its related systems; to introduce any virus, malicious code or disruptive material; to interfere with the operation of the Platform; or to resell products purchased from us under any other brand without our written agreement.
10. User-generated content
Where you submit reviews, photographs, comments or other content to the Platform, you grant us a non-exclusive, worldwide, royalty-free, perpetual and transferable licence to use, reproduce, adapt, publish and display such content in connection with our business. You represent that such content is lawfully yours to share and is not defamatory, obscene, infringing or otherwise unlawful. We reserve the right to remove any content at our sole discretion and without notice.
11. Third-party links and services
The Platform may contain links to third-party websites or services that are not owned or controlled by us. We assume no responsibility for the content, policies or practices of any third party, and access to such websites is at your own risk.
12. Disclaimer of warranties
The Platform is provided on an “as is” and “as available” basis. While we take reasonable care to maintain the Platform, we do not warrant that access will be uninterrupted, timely, secure or free from error, or that the Platform will be free from viruses or other harmful components.
13. Limitation of liability
To the maximum extent permitted by law, our aggregate liability arising out of or in connection with any order shall not exceed the amount actually paid by you for that order. We shall not be liable for any indirect, incidental, special or consequential loss, including loss of profit, revenue, goodwill or opportunity. Nothing in this clause shall limit any liability that cannot be excluded under the Consumer Protection Act, 2019 or other applicable law.
14. Indemnity
You agree to indemnify and hold harmless Deccan Drip, its proprietors, employees and agents against any claim, demand, loss, liability or expense arising out of your breach of these Terms or your violation of any law or third-party right.
15. Force majeure
We shall not be liable for any delay or failure in performance caused by circumstances beyond our reasonable control, including acts of God, natural calamities, epidemics, strikes, civil unrest, courier or logistics failures, governmental action, or failure of telecommunications or power networks.
16. Termination
We reserve the right to suspend or terminate your access to the Platform, without notice, where we reasonably believe you have breached these Terms or engaged in fraudulent or unlawful conduct.
17. Amendments
We may amend these Terms at any time at our sole discretion. Amendments take effect upon publication on this page. The version of these Terms published at the time you place an order shall govern that order. Your continued use of the Platform following publication of any amendment constitutes acceptance of the revised Terms.
18. Governing law and jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Subject to your statutory consumer rights, the courts at Hyderabad, Telangana shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.
